With the following data protection information, we would like to inform you about the processing of personal data by Berlin Partner für Wirtschaft und Technologie GmbH and about your rights as a data subject:
1. Who is responsible for data processing and who can I contact?

2. What personal data do we process?
According to Art. 4 No. 1 GDPR, personal data is any information relating to an identi-fied or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, address and other contact details or to one or more personal attributes that are an expression of that natural person's physical, physiological, genetic, mental, eco-nomic, cultural or social identity.
As part of the #FARBENBEKENNEN Award 2021, Berlin Partner für Wirtschaft und Technologie GmbH will generally processes the first and last names of the child/young person and the legal representative, address, e-mail address, telephone number, date of birth, country and place of birth, optional: Photo, video and/or web address proving how applicant is engaged, occupation and date and time of registration.
In many cases, it is either not possible, or would be disproportionate, within the context of the activities to work with anonymised or pseudonymised data.
3. What do we process your data for (pur-pose of processing) and on what legal basis?
In particular, we will process your data to check the necessary eligibility criteria for participation in the #FARBENBEKENNEN Award 2021. The conditions of participation are online at www.farbenbekennen.de .
The details of the data processed are set out in Point 2.
Berlin Partner für Wirtschaft und Technologie GmbH will process your personal data in compliance with data protection laws and use it solely for the aforementioned pur-pose in accordance with data protection regulations. This shall be done on the basis of one of the legal bases listed below:
a) Insofar as you have given Berlin Partner für Wirtschaft und Technologie GmbH consent to process personal data for the #FARBENBEKENNEN Award 2021, the lawfulness of this processing is given on the basis of your consent (Art. 6 (1) p. 1 lit. a) GDPR),
b) for the fulfilment of a legal obligation (Art. 6 (1) p.1 lit. c) GDPR),
c) for the fulfilment of public tasks (Art. 6 (1).m p 1 lit. e) GDPR).
4. Who gets my data (recipient)?
Access rights to the personal data are granted to Department I C and the Bv Office of the Berlin Senate Chancellery, as the client of the project, as well as to the com-missioned data processor, namely Connex Berlin, which has been commissioned with the implementation of the #FARBENBEKENNEN Award 2021, in order to ensure that the project runs smoothly.
5. Will data be trans-ferred to a third country or to an international organisation?
No transfer of personal data to countries outside the European Economic Area (EEA), so-called third parties shall take place.
6. How long will my data be stored?
Unless otherwise stipulated by statutory retention periods, we will delete your data under point 2 after the end of the #FARBENBEKENNEN Award 2021, but no later than by 31.12.2021.
7. What data protection rights do I have (data subject rights)?
Every data subject has the right vis-à-vis the Senate Chancellery to
• information about the processing of their personal data (this also includes in-formation about the purpose, recipients and duration of storage) (Art. 15 GDPR),
• rectification of inaccurate data (Art. 16 GDPR),
• to deletion (Art. 17 GDPR),
• to restriction of processing and data portability (Art. 18 and 20 GDPR) as well as
• object to the processing of your data at any time (Art. 21 GDPR). If you object, your personal data will no longer be processed. An exception shall apply where compelling reasons worthy of protection outweighing your interests exist.

Once consent has been given, it can be revoked at any time with effect for the future vis-à-vis Berlin Partner für Wirtschaft und Technologie GmbH. The lawfulness of the processing carried out on the basis of the consent until revocation shall not be affected thereby. In this case, we may not be able to help you with your request. The revocation is to be addressed to the contact address mentioned in Section 1 (Data Protection Officer).
In order to protect all rights mentioned in this section, any data subject may contact the Data Protection Officer of Berlin Partner für Wirtschaft und Technologie GmbH (see Section 1).
In addition, if you are of the opinion that Berlin Partner für Wirtschaft und Technologie GmbH has not complied with data protection regulations when processing your data, you can lodge a complaint with the competent supervisory authority. Data subjects can address their complaint to the authority of their place of residence, but in principle also to any other data protection supervisory authority.
8. Is there an obligation for me to provide data?
There is no obligation to make personal data available to Berlin Partner für Wirtschaft und Technologie GmbH for inquiries or requests. However, we can only respond to your request/concern if we are able to contact you.
9. Is there any automated decision making or profiling?
No automated decision-making shall take place, nor shall user profiles be created (profiling) in accordance with Art. 22 (1) and (4) GDPR.
Conditions of Participation –
#FARBENBEKENNEN-Award
The #FARBENBEKENNEN award honors outstanding commitment shown by refugees. The motto of this year's award is "World Class". The award is given to children and young people with a refugee background who have shown exceptional commitment, whether as class representatives, in school initiatives or as volunteers in civil society organisations.
1. Organiser
The organiser of the #FARBENBEKENNEN Award is the Senate Chancellery of Berlin, Jüdenstraße 1, 10178 Berlin. The organiser has commissioned Berlin Partner für Wirtschaft und Technologie GmbH (hereinafter referred to as Berlin Partner), Fasanenstraße 85, 10623 Berlin, with the implementation of the competition.
2. Eligibility
All natural persons with an immigration history and current main residence in Berlin are eligible to participate, who
- are between 8 and 16 years old.
- came to Berlin in 2010 or later.
- volunteer with school-based initiatives, civic organisations, or similar.
As participants are minors (i.e. under 18 years of age) at the time of participation, they are only eligible to participate if their
legal guardian has given their consent to the participation. The organiser is entitled to have this declaration of consent
submitted in writing. Should this not take place, despite a request to do so, participation in the competition shall be excluded.
Employees of the organiser or of Berlin Partner GmbH and their family members are not entitled to participate.
3. Participation
To enter the competition, you must submit a full application using the application form on the website www.farbenbekennen.de.
The submission of the completed questionnaire is considered as consent to participate in the #FARBENBEKENNEN Award.
Applications will be accepted from 14th February until 21st March 2021. The application must be written in either German or
English.
Participants are responsible for the accuracy of their data and asked to only submit entries for which they have the right to do so.
The organiser may use the documents submitted by the participants for the purpose of evaluation by the jurors, for press and
media work within the framework of the competition, for presentation at the award ceremony and for communication with the
target groups in various types of communication.
A submitted photo must be accompanied by the name of the photographer or copyright holder. In case of doubt, a written
declaration of consent from the persons depicted must be able to be presented. By submitting the photo, the participants or the
author transfer the simple and limited rights of use to the organiser and also assure that the persons depicted agree to the
publication thereof. Participants who are minors must submit a written declaration of consent from their legal guardians.
Participation in the competition is free of charge. Participants are fully responsible for any expenses incurred in the course of
their participation. No reimbursement will be made.
4. Selection procedure and notification
The jury of the #FARBEBEKENNEN Award will select the winner of the Jury Award from all complete applications submitted by
the deadline in a jury meeting on 14th April 2021 and they will select the three applicants for the online voting for the Audience
Award. In the event of a large number of participants, the organiser may make a preliminary selection of the entries submitted
for the jury. The decision of the jury and, if applicable, the organiser shall be binding for all participants and cannot be appealed.
The announcement of the three finalists or finalists for the Audience Award will be made via e-mail during the week of 19th-23rd
April 2021. They will automatically participate in the online voting.
The three finalists and the winner of the Jury Award will be presented on the website www.farbenbekennen.de as well as in other
public relations materials (e.g. press releases) via text, images and film. In addition, a picture motif will be created by the three
finalists and the Jury Award winner. The finalists must make themselves available for this purpose. The motif will be used for
communication activities (posters, website, social media, etc.) after consultation with the award winner.
The public online voting for the winner of the Audience Award will take place from June to July 2021 at www.farbenbekennen.de.
Each person participating in the online voting will be able to cast one vote. The finalist with the most votes will win. In the event
of a tie, a decision shall be made by drawing lots.
The jury is entitled to award a special prize for special achievements at its own discretion.
Award winners will be officially announced and honoured at an awards ceremony in late August or early September 2021.
5. Prizes
The winners of the #FARBENBEKENNEN Award 2021 will be awarded with two different prizes.
The Jury Award comes with a prize of 5,000 Euro. In addition, the winner will receive a trophy for his or her special commitment.
The winner of the Audience Award will receive 3,500 Euro, with the 2nd place winner receiving 2.000 Euro and the 3rd place
winner receiving 2,000 Euro.
The prize money may only be used for charitable purposes that are related to the award winners’ project. Tax assessment of the
prize money is the responsibility of the prize winner.
6. Data protection
The personal data collected in the course of participation will only be transmitted and stored for the purposes of the competition
(evaluation, documentation, presentation) by the organiser and third parties commissioned with this for data processing and
data use. The aforementioned personal data may be used for the publication of entries in the competition. Personal data will be
used exclusively for the aforementioned purposes.
Berlin Partner für Wirtschaft, Technologie und Recht GmbH will process the data within the framework of the competition and
submit such to the organiser for the pre-selection of the jury decision. The following data will be processed in the context of a
participation or application for the #FARBENBEKENNEN Award 2021: first and last name of the child/young person and legal
guardian, address, e-mail address, telephone number, date of birth, country and place of birth. A photo, video and/or web
address proving how applicant is engaged, occupation and date and time of registration may be optionally provided.

7. Premature termination, compensation
The organiser reserves the right to stop, suspend, change or postpone the competition at any time, even partially, especially if
proper execution of the competition can no longer be guaranteed for technical or legal reasons.
The organiser reserves the right to exclude participants from the competition. This applies in particular to violations of the
conditions of participation and if participants use manipulation or other dishonest means. The organiser may also declare such
an exclusion retrospectively, withdraw prize money and reclaim the same.
Should a participant be excluded from the competition, the applicant with the next highest score according to the number of
votes of the expert jury or in the online voting shall take his/her place.
Any liability for damages on the part of the organiser and its bodies, employees and vicarious agents arising from, or in
connection with, the competition, irrespective of the legal grounds, shall be limited, insofar as legally permissible, to cases of
intent or gross negligence. Furthermore, the organiser accepts no liability for any third parties gaining knowledge of the
documents submitted in connection with the competition and for any consequences resulting therefrom.
8. Final provisions
The judges' decision shall be final. The law of the Federal Republic of Germany shall apply exclusively. Should any of these provisions be or become invalid, the validity of the remaining provisions shall not be affected.
